Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BuskerBeat mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

BuskerBeat reserves the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to create an account on BuskerBeat. Users under 18 must have parental or guardian consent. By using the App, you represent that you meet these eligibility requirements.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You may register as a Busker (street performer) or a Fan.
• One person may not maintain more than one account.
• BuskerBeat reserves the right to suspend or terminate accounts that violate these Terms.

4. Stars & Virtual Currency

BuskerBeat uses a virtual currency called "Stars" that allows fans to tip and support street performers.

• Stars are purchased through in-app transactions powered by Stripe.
• Stars have a fixed conversion rate to USD as displayed in the App.
• Buskers may withdraw their earned Stars as real currency to their connected payment account, subject to minimum withdrawal thresholds and processing fees.
• Stars are non-refundable once sent to a performer.
• BuskerBeat reserves the right to modify Star pricing and conversion rates with prior notice.

5. Platform Fees

BuskerBeat charges a platform fee on Stars received by buskers. The fee is automatically deducted before withdrawal and is based on the busker's membership tier:

• Free Tier: 25% platform fee on Stars received.
• Pro Tier: 15% platform fee on Stars received.
• Elite Tier: 10% platform fee on Stars received.

The platform fee is clearly displayed on the Withdrawal page, where the eligible withdrawal amount (after fee deduction) is shown before you confirm the transaction. BuskerBeat reserves the right to adjust platform fees with prior notice to users.

6. Membership Tiers

BuskerBeat offers three membership tiers for Buskers:

• Free: Basic profile, photo uploads, limited features.
• Pro ($8/month or $79/year): Go Live streaming, custom profile URL, photo tipping enabled.
• Elite ($19/month or $149/year): All Pro features plus verified badge, priority support, and premium visibility.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. A 3-day free trial is available for new subscribers.

7. Content & User Conduct

You retain ownership of the content you post. By posting content on BuskerBeat, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.

You agree NOT to:

• Post content that is illegal, harmful, threatening, abusive, or harassing.
• Upload sexually explicit, violent, or graphic material.
• Impersonate other performers or users.
• Use the platform to spam, scam, or mislead others.
• Attempt to manipulate the tipping system or exploit the Stars currency.
• Violate any intellectual property rights of third parties.

8. Hire a Busker Feature

The "Hire a Busker" feature allows fans to request quotes and book performers for events.

• BuskerBeat acts as a facilitator, not a party to any booking agreement between buskers and fans.
• All booking terms, pricing, and arrangements are between the busker and the hiring party.
• BuskerBeat is not responsible for the quality, safety, or outcome of any booked performance.
• Disputes between buskers and hiring parties should be resolved directly between the parties.

9. Live Streaming

Live streaming is available to Pro and Elite tier members. By going live, you agree to:

• Not broadcast content that violates our Community Guidelines.
• Not stream pre-recorded content as live content.
• Accept that BuskerBeat may terminate a live stream at any time if it violates our policies.

10. Limitation of Liability

BuskerBeat is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you have paid to BuskerBeat in the 12 months preceding any claim.

11. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms. Upon termination, your right to use the App ceases immediately. Any Stars balance in your account at the time of termination may be forfeited if the termination is due to a Terms violation.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration.
